1. INTRODUCTION AND PURPOSE

1.1 Code of Conduct Overview

This User Agreement & Code of Conduct ("Code") establishes the professional standards, behavioral expectations, and safety requirements for all users of the bartendersNow™ platform. This Code supplements our Terms of Service and is designed to create a safe, professional, and respectful environment for all participants.

Our Mission: To maintain a marketplace where professional bartenders and event hosts can connect with confidence, safety, and mutual respect.

1.2 Scope and Application

This Code applies to:

  • All registered platform users (Hosts, Bartenders, and general users)
  • All platform interactions and communications
  • All services arranged through the platform
  • All platform-related activities and events
  • All user-generated content and reviews

1.3 Compliance Obligation

By using the bartendersNow™ platform, you agree to:

  • Follow all provisions of this Code of Conduct
  • Maintain professional standards at all times
  • Respect the rights and safety of all users
  • Report violations and safety concerns promptly
  • Cooperate with platform investigations and enforcement

2. PROFESSIONAL STANDARDS

2.1 General Professionalism

All users must:

  • Conduct themselves with integrity and honesty
  • Communicate respectfully and professionally
  • Honor commitments and agreements made through the platform
  • Provide accurate and truthful information
  • Maintain confidentiality when appropriate
  • Respect diverse backgrounds, beliefs, and preferences

Professional Communication:

  • Use clear, respectful language in all interactions
  • Respond to messages and inquiries promptly
  • Provide complete and accurate information
  • Avoid discriminatory or offensive language
  • Maintain professional boundaries

2.2 Bartender Professional Standards

Licensing and Certification:

  • Maintain all required professional licenses and certifications
  • Keep RBS (Responsible Beverage Service) certification current where required
  • Provide proof of credentials when requested
  • Comply with continuing education requirements
  • Stay informed about industry regulations and best practices

Service Excellence:

  • Arrive punctually and prepared for all events
  • Personally perform every booking you accept; never send another person in your place unless they are separately registered, identity-verified, and booked for that event through the platform
  • Bring appropriate professional attire and equipment
  • Provide high-quality bartending services consistent with industry standards
  • Follow responsible alcohol service practices
  • Maintain cleanliness and sanitation standards

Client Relations:

  • Communicate event requirements and expectations clearly
  • Provide accurate time estimates and service capabilities
  • Offer professional recommendations and guidance
  • Handle guest interactions with courtesy and professionalism
  • Resolve issues diplomatically and professionally

2.3 Host Professional Standards

Event Planning:

  • Provide accurate event details and requirements
  • Communicate needs and expectations clearly
  • Respect agreed-upon timelines and arrangements
  • Prepare appropriate event space and facilities
  • Ensure guest safety and appropriate behavior

Bartender Relations:

  • Treat bartenders with respect and professionalism
  • Provide necessary event information and access
  • Honor agreed-upon compensation and terms
  • Respect professional expertise and recommendations
  • Facilitate safe and professional working conditions

Guest Management:

  • Maintain responsibility for guest behavior and safety
  • Ensure compliance with age verification requirements
  • Intervene in inappropriate guest behavior
  • Provide safe and accessible event environment
  • Support bartender's professional service decisions

3. SAFETY REQUIREMENTS

3.1 General Safety Obligations

All users must:

  • Prioritize safety of themselves and others
  • Follow all applicable safety laws and regulations
  • Report safety hazards and incidents promptly
  • Cooperate with safety investigations
  • Maintain appropriate insurance coverage

Safety Communication:

  • Share relevant safety information before events
  • Report potential hazards or concerns immediately
  • Maintain open communication during events
  • Document safety incidents thoroughly
  • Follow platform safety reporting procedures

3.2 Alcohol Service Safety

Mandatory Requirements:

  • ZERO TOLERANCE for serving alcohol to minors
  • Strict adherence to age verification procedures
  • Refuse service to visibly intoxicated individuals
  • Monitor guest consumption and behavior
  • Intervene appropriately in concerning situations

Age Verification Protocol:

  • Check valid government-issued photo ID for all guests appearing under 30
  • Verify ID authenticity and match to person presenting
  • Refuse service when identification cannot be verified
  • Document verification procedures when required
  • Report attempted minor service to platform immediately

Responsible Service Practices:

  • Monitor guest consumption levels throughout events
  • Provide food and non-alcoholic alternatives
  • Recognize and respond to signs of intoxication
  • Implement service refusal procedures when necessary
  • Arrange safe transportation for impaired guests

3.3 Personal Safety Measures

Location Safety:

  • Share event location and contact information with trusted contacts
  • Verify event legitimacy and host identity before arrival
  • Trust instincts about potentially unsafe situations
  • Maintain personal safety equipment and communication devices
  • Have exit strategies and emergency contact procedures

Physical Safety:

  • Report any threats, harassment, or inappropriate behavior
  • Maintain awareness of surroundings and potential hazards
  • Use proper lifting and equipment handling techniques
  • Avoid working alone in isolated or potentially dangerous situations
  • Follow venue-specific safety procedures and requirements

Financial Safety:

  • Use only platform-approved payment methods
  • Never share financial account information directly with other users
  • Report payment disputes through proper platform channels
  • Maintain records of all transactions and agreements
  • Be cautious of requests for cash payments or off-platform transactions

4. PROHIBITED CONDUCT

4.1 Zero Tolerance Violations

The following behaviors result in immediate account termination:

Alcohol-Related Violations:

  • Serving alcohol to anyone under 21 years of age
  • Knowingly providing false identification or age verification
  • Encouraging or facilitating underage drinking
  • Operating under the influence of alcohol or drugs

Safety Violations:

  • Threatening or engaging in violence
  • Sexual harassment or inappropriate sexual conduct
  • Discrimination based on protected characteristics
  • Endangering the safety of others

Legal Violations:

  • Engaging in any illegal activities
  • Violating applicable laws and regulations
  • Fraudulent activity or misrepresentation
  • Operating without required licenses or permits

4.2 Material Breach Violations

The following behaviors constitute material breach of the User Agreement and may result in termination of platform access:

Professional Misconduct:

  • Consistent failure to meet professional standards
  • Breach of confidentiality or privacy
  • Misrepresentation of qualifications or experience
  • Sending, subcontracting, or permitting another person to perform a booking in your place, unless that person is separately registered, identity-verified, and booked for that event through the platform (Terms of Service Section 7.6)
  • Failure to honor platform agreements and commitments

Platform Abuse:

  • Attempting to circumvent platform systems or fees
  • Creating multiple accounts to evade restrictions
  • Manipulating reviews or ratings systems
  • Spamming or excessive unwanted communications

Discrimination and Harassment:

  • Discriminatory behavior based on race, gender, religion, sexual orientation, or other protected characteristics
  • Bullying, harassment, or intimidation of other users
  • Retaliatory behavior against users who report violations
  • Creating hostile or unwelcoming environments

4.3 Correctable Compliance Issues

The following issues may be addressed through a cure period before any access restriction:

Communication Issues:

  • Unprofessional or disrespectful communication
  • Failure to respond to platform communications
  • Inappropriate use of platform messaging systems
  • Minor misunderstandings or disputes

Service Issues:

  • Minor punctuality or preparation issues
  • Small discrepancies in service delivery
  • Miscommunication about event requirements
  • Technical difficulties affecting service

For correctable compliance issues, users will receive written notice identifying the deficiency and will have a reasonable cure period (typically 48-72 hours) to resolve the issue. See Section 10.2 for details on the cure process.

4.4 Prohibited Uploaded Content (Images & Media)

You may not upload, post, or display any image or media that: (a) depicts nudity, sexual or sexually suggestive content, or pornography; (b) sexualizes, exploits, or endangers a minor in any way — child sexual abuse material is strictly prohibited, will be preserved and reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, and will result in immediate permanent termination and referral; (c) depicts graphic violence, gore, or self-harm; (d) promotes hate, harassment, or discrimination against protected groups; (e) infringes any third party's copyright, trademark, or other intellectual-property rights; (f) depicts an identifiable individual without their consent; (g) depicts, encourages, or markets the service of alcohol to minors or unsafe/over-service of alcohol; or (h) depicts illegal activity. We may remove any content and suspend or terminate accounts for violations at our sole discretion.


5. ANTI-DISCRIMINATION POLICY

5.1 Equal Treatment Commitment

bartendersNow™ is committed to providing equal opportunities and treatment for all users regardless of:

  • Race, color, or national origin
  • Religion or religious beliefs
  • Gender, gender identity, or gender expression
  • Sexual orientation
  • Age (except as required by law for alcohol service)
  • Disability or accessibility needs
  • Marital or family status
  • Military or veteran status
  • Any other characteristic protected by law

5.2 Prohibited Discrimination

Users may not:

  • Refuse service based on protected characteristics
  • Make discriminatory comments or statements
  • Engage in harassment based on protected status
  • Create barriers to access based on protected characteristics
  • Retaliate against users who report discrimination

5.3 Accessibility Requirements

Platform Commitment:

  • Provide accessible platform features and interfaces
  • Support assistive technologies and accessibility tools
  • Accommodate users with disabilities when possible
  • Follow WCAG 2.1 AA accessibility standards

User Obligations:

  • Respect accessibility needs of other users
  • Provide reasonable accommodations when requested
  • Communicate accessibility requirements clearly
  • Support inclusive and accessible events

6. COMMUNICATION STANDARDS

6.1 Platform Communication Rules

All platform communications must:

  • Remain professional and respectful
  • Stay relevant to platform business and services
  • Protect privacy and confidentiality
  • Avoid spam, solicitation, or excessive messages
  • Follow platform terms and policies

Prohibited Communications:

  • Harassment, threats, or intimidation
  • Discriminatory or hate speech
  • Sexually explicit or inappropriate content
  • Commercial solicitation outside platform services
  • Sharing personal contact information to circumvent platform

6.2 Response Requirements

Professional Response Standards:

  • Respond to booking inquiries within 24 hours
  • Acknowledge receipt of important communications promptly
  • Provide complete and accurate information
  • Use clear and professional language
  • Follow up on commitments and agreements

Emergency Communication:

  • Report safety issues immediately
  • Respond to urgent platform communications promptly
  • Maintain accessible communication during events
  • Provide emergency contact information when required

6.3 Privacy and Confidentiality

Information Protection:

  • Protect personal information of other users
  • Maintain confidentiality of event details
  • Respect privacy preferences and settings
  • Report privacy violations or data breaches
  • Follow platform privacy policies and procedures

Appropriate Sharing:

  • Share only necessary information for service provision
  • Obtain consent before sharing user information with third parties
  • Use information only for legitimate platform purposes
  • Delete or return confidential information when appropriate

7. REVIEW AND RATING SYSTEM

7.1 Honest and Fair Reviews

Review Standards:

  • Provide honest and accurate feedback
  • Base reviews on actual experience and service received
  • Include specific and constructive information
  • Avoid personal attacks or inappropriate content
  • Focus on service quality and professional conduct

Prohibited Review Practices:

  • Fake or fraudulent reviews
  • Reviews based on discrimination or bias
  • Retaliatory or vindictive reviews
  • Reviews including inappropriate personal information
  • Attempts to manipulate ratings or review systems

7.2 Review Response Guidelines

Responding to Reviews:

  • Respond professionally to all feedback
  • Thank users for positive reviews
  • Address concerns in negative reviews constructively
  • Avoid defensive or argumentative responses
  • Use reviews as opportunities for improvement

Dispute Resolution:

  • Report fake or inappropriate reviews through proper channels
  • Provide evidence to support dispute claims
  • Work with platform support to resolve review issues
  • Focus on improving service rather than disputing reviews

8. FINANCIAL CONDUCT

8.1 Payment Integrity

All users must:

  • Honor agreed-upon pricing and payment terms
  • Use only platform-approved payment methods
  • Provide accurate financial information
  • Report payment issues through proper channels
  • Avoid fraudulent or deceptive financial practices

Prohibited Financial Conduct:

  • Attempting to bypass platform payment systems
  • Requesting or making cash payments outside the platform
  • Charging unauthorized fees or surcharges
  • Engaging in money laundering or financial fraud
  • Disputing legitimate charges or payments

8.2 Pricing and Fee Transparency

Fair Pricing Practices:

  • Provide clear and accurate pricing information
  • Honor quoted prices and estimates
  • Disclose all fees and charges upfront
  • Avoid deceptive pricing practices
  • Communicate pricing changes promptly

Platform Fee Compliance:

  • Accept platform service fees as part of using the service
  • Not attempt to circumvent or avoid platform fees
  • Understand fee structure and payment processing
  • Report fee discrepancies through proper channels

9. INCIDENT REPORTING AND RESPONSE

9.1 Reporting Obligations

Users must report:

  • Safety incidents or concerns
  • Violations of this Code of Conduct
  • Illegal activities or behavior
  • Discrimination or harassment
  • Platform abuse or system violations

Reporting Procedures:

  • Use platform reporting tools when available
  • Provide detailed and accurate information
  • Submit reports promptly after incidents
  • Cooperate with platform investigations
  • Maintain confidentiality during investigations

9.2 Investigation Process

Platform Investigation:

  • All reports will be reviewed promptly and thoroughly
  • Users must cooperate with investigation requests
  • Confidentiality will be maintained to the extent possible
  • Evidence and documentation will be collected and preserved
  • Appropriate enforcement actions will be taken

User Cooperation:

  • Respond to investigation requests promptly
  • Provide honest and complete information
  • Preserve relevant evidence and documentation
  • Respect investigation confidentiality
  • Accept investigation outcomes and enforcement decisions

9.3 Emergency Procedures

Immediate Safety Concerns:

  • Contact emergency services (911) for immediate safety threats
  • Remove yourself from dangerous situations when possible
  • Report incidents to platform as soon as safely possible
  • Document incidents thoroughly for investigation
  • Cooperate with law enforcement when required

Platform Emergency Response:

  • Immediate suspension of accounts for serious safety violations
  • Cooperation with law enforcement investigations
  • Support for users involved in safety incidents
  • Review and improvement of safety procedures
  • Communication with affected users and community

10. PLATFORM ACCESS AND TERMINATION

10.1 Compliance Requirement

Your continued access to the bartendersNow™ platform is contingent upon compliance with this User Agreement and all applicable laws. bartendersNow™ is a marketplace facilitator and does not supervise, direct, or control how you provide or receive services.

10.2 Correctable Compliance Issues

For administrative or technical compliance issues that can be corrected (such as expired RBS certification or incomplete profile documentation):

  • You will receive written notice identifying the compliance deficiency
  • You will have a reasonable cure period (typically 48-72 hours) to resolve the issue
  • Platform access may be temporarily restricted during the cure period
  • Access will be restored upon verification of compliance

10.3 Material Breach and Termination

The following constitute material breaches resulting in immediate and permanent termination of platform access:

  • Service of alcohol to any person under 21 years of age
  • Criminal conduct in connection with platform services
  • Fraud, misrepresentation, or falsification of credentials
  • Any conduct that endangers the safety of others
  • Violation of applicable alcohol service laws
  • Breach of licensing requirements after notice and failure to cure
  • Falsely representing, altering, or forging credentials, licenses, or insurance documentation provided directly to Hosts, venues, or the platform

Termination is final. There is no appeal process for material breaches.

10.4 Platform Rights

bartendersNow™ reserves the right to:

  • Terminate any user's access at any time for material breach
  • Report illegal activity to appropriate law enforcement and regulatory authorities
  • Cooperate with legal investigations
  • Pursue legal remedies for contract breach or damages

10.5 No Discipline or Penalties

IMPORTANT: bartendersNow™ does not impose fines, financial penalties, mandatory training, supervision periods, or progressive discipline on users. The platform's sole enforcement mechanism is restriction or termination of access. Users are independent contractors or customers, not employees subject to workplace discipline.


11. EDUCATION AND SUPPORT

11.1 Ongoing Education

Platform Commitment:

  • Provide regular training and educational resources
  • Update users on policy and regulatory changes
  • Share best practices and professional development opportunities
  • Offer safety training and awareness programs

User Responsibility:

  • Participate in required training programs
  • Stay informed about platform policies and updates
  • Pursue professional development opportunities
  • Share knowledge and best practices with community

11.2 Support Resources

Available Support:

  • Customer service for platform questions
  • Safety support for incident reporting and response
  • Educational resources for professional development
  • Community forums for peer support and networking

Accessing Support:

  • Contact platform support through designated channels
  • Use help resources and documentation
  • Participate in community discussions and forums
  • Attend training sessions and educational events

12. UPDATES AND MODIFICATIONS

12.1 Policy Updates

This Code of Conduct may be updated to reflect:

  • Changes in legal requirements and regulations
  • Platform growth and evolving community needs
  • Industry best practices and standards
  • User feedback and community input

12.2 Notice of Changes

Users will be notified of updates through:

  • Email notifications to registered users
  • Platform announcements and notifications
  • Updated documentation with clear change indicators
  • Grace periods for compliance with new requirements

12.3 Acceptance of Updates

Continued platform use constitutes acceptance of updated policies.

  • Discontinue platform use if unable to comply with updates
  • Understand that violation of updated policies may result in enforcement action

  • You accept the platform's right to enforce these standards

You commit to:

  • Upholding professional standards and safety requirements

  • Supporting the platform's mission and values
  • Continuously improving your professional conduct and services

This User Agreement & Code of Conduct is effective as of July 20, 2026 and applies to all platform activities from that date forward.

By continuing to use bartendersNow™, you acknowledge that you have read, understood, and agree to be bound by this Code of Conduct.
