CRITICAL PLATFORM DISCLOSURE

IMPORTANT: This document describes recommended insurance standards for independent bartending businesses. It does not impose insurance as a condition of using the bartendersNow™ platform.

THE PLATFORM DOES NOT COLLECT, REVIEW, VERIFY, OR STORE CERTIFICATES OF INSURANCE (COIs). bartendersNow™ does not require, provide, verify, or guarantee insurance coverage for Bartenders or Hosts, and does not monitor policy status or expiration.

Hosts are solely responsible for requesting and independently validating a Certificate of Insurance directly from their chosen Bartender if proof of coverage is important to them. The platform provides this guide as an educational resource only and does not provide insurance advice.


EXECUTIVE SUMMARY

This guide sets out recommended industry-standard insurance coverage for independent contractor Bartenders who operate their own businesses. The coverage levels below are advisory guidance, not platform requirements, and are provided to help independent professionals make informed decisions about protecting their businesses.

Legal Authority: This guide is provided pursuant to Terms of Service Section 4.4 (Insurance — Advisory Model and Disclaimers) and reflects California marketplace facilitator law and insurance industry best practices for independent contractor relationships.


PART 2: RECOMMENDED INSURANCE STANDARDS FOR BARTENDERS (ADVISORY)

1. Platform Advisory Role

bartendersNow™ is a technology marketplace, not an insurer or employer.

THE PLATFORM DOES NOT COLLECT, REVIEW, VERIFY, OR STORE CERTIFICATES OF INSURANCE (COIs). The coverage limits below represent recommended industry standards for independent bartending businesses operating in California.

2. Recommended Coverage Standards for Bartenders

Independent contractor Bartenders are strongly advised to maintain:

  • General Liability Insurance: $1,000,000 per occurrence / $2,000,000 aggregate
  • Liquor Liability Insurance: $1,000,000 per occurrence / $2,000,000 aggregate

These figures are recommended standards, not platform requirements. Coverage decisions, limits, carriers, and endorsements are entirely at the independent Bartender's discretion and are a matter between the Bartender, the Host, and any event venue.

3. Direct COI Exchanges Between Hosts and Bartenders

Because the platform does not collect or verify insurance documents:

  • Hosts requiring proof of insurance must request a Certificate of Insurance directly from their booked Bartender prior to the event.
  • Bartenders are solely responsible for providing proof of coverage directly to Hosts or event venues upon request.
  • Midnight Logic, Inc. does not monitor policy expiration dates, validate endorsements, or enforce technical account suspensions related to insurance status.

4. Venue Requirements

Insurance requirements imposed by event venues (including General Liability, Commercial Auto, Workers' Compensation, or Additional Insured status) are strictly between the Host, the Bartender, and the venue. bartendersNow™ is not a party to venue contracts and does not enforce venue insurance terms.


HOST INSURANCE COMPLIANCE (RECOMMENDATIONS)

Note: The following Host insurance recommendations are provided as educational guidance. The platform does not verify Host insurance coverage. Hosts are responsible for ensuring adequate coverage for their events.

Residential Events

Homeowner's/Renter's Insurance Review:

  • Minimum liability coverage of $300,000 (recommended $500,000)
  • Personal liability coverage for social host activities
  • Property damage coverage for event-related incidents
  • Medical payments coverage for guest injuries

Commercial Events

Recommended Coverage:

  • Commercial General Liability: $1,000,000 per occurrence
  • Liquor Liability: $1,000,000 per occurrence (for alcohol events)
  • Property Coverage: Full replacement cost for venue/equipment
  • Workers' Compensation: As required by state law

Special Event Insurance

Large Event Considerations (100+ guests):

  • Special Event General Liability policy
  • Event cancellation and postponement coverage
  • Weather and force majeure coverage options
  • Vendor liability and performance coverage

Venue Requirements

  • Compliance with any venue insurance requirements
  • Certificate of Insurance provision to venues where required
  • Coordination with the Bartender's own coverage

CLAIMS AND INCIDENTS

Platform Role in Claims

bartendersNow™ is NOT a party to insurance claims between Hosts, Bartenders, guests, and insurance carriers. The platform:

  • Does not coordinate insurance claims
  • Does not mediate coverage disputes
  • Does not verify claim validity
  • Does not communicate with insurance carriers on users' behalf

User Responsibilities

In the event of an incident:

  • Users must contact their own insurance carriers directly
  • Users must follow their policy's claim reporting procedures
  • Users should document incidents thoroughly
  • Users are responsible for all claim processes

Platform Reporting

Users should report significant incidents to the platform for safety monitoring purposes, but this does not constitute insurance claim filing.
