The bartendersNow™ platform connects independent contractor bartenders with event hosts. All users must understand and comply with applicable alcohol service laws. This notice provides general guidance about California requirements, but users should consult legal counsel and official sources for specific situations.

We do NOT:
- Provide bartending services directly
- Make alcohol service decisions
- Monitor or supervise alcohol service at events
- Ensure compliance with alcohol service laws
- Assume responsibility for user compliance
ALL USERS ARE SOLELY RESPONSIBLE FOR UNDERSTANDING AND COMPLYING WITH APPLICABLE ALCOHOL SERVICE LAWS.
This includes:
- Federal, state, and local alcohol regulations
- Licensing and permit requirements
- Professional certification obligations
- Liability and insurance requirements
- Safety and responsible service practices
CALIFORNIA LAW:
- Legal drinking age is 21 years old
- NO EXCEPTIONS for any circumstances
- Serving alcohol to anyone under 21 is a criminal offense
ZERO TOLERANCE ENFORCEMENT:

MANDATORY IDENTIFICATION CHECK:

CALIFORNIA LAW PROHIBITS:
- Serving alcohol to visibly intoxicated persons

SIGNS OF INTOXICATION:
- Slurred speech or difficulty speaking
- Unsteady walking or loss of coordination

CALIFORNIA BUSINESS AND PROFESSIONS CODE §23399.1:
Licensed Premises: If serving at venues with valid ABC licenses (bars, restaurants, hotels), bartenders MUST have current RBS certification.
Private Events: For private events meeting specific criteria (no sale of alcohol, not open to public, premises not maintained for alcohol service), RBS certification may not be legally mandated by state law.
IMPORTANT DISTINCTION: Even when not legally required, RBS certification demonstrates professionalism and knowledge of responsible service practices.

GENERAL RULE: California law generally protects social hosts from liability for alcohol-related incidents involving adult guests.
Legal Principle: "The consumption of alcoholic beverages, rather than the furnishing of alcoholic beverages, is the proximate cause of injuries inflicted upon another by an intoxicated person."
CRITICAL EXCEPTION: Social hosts CAN be held liable for serving alcohol to persons under 21 years of age.
California Business and Professions Code §25658:
- It is unlawful to sell or furnish alcohol to minors
- Social hosts who "knowingly furnish" alcohol to minors may face liability
- Liability applies when host knows or should know guest is under 21

To maintain platform access, bartenders providing alcohol service must:
- Maintain current RBS certification (for events at licensed premises)
- Complete platform onboarding requirements
- Comply with all applicable California alcohol service laws
For documentation lapses or administrative issues:
- You will receive written notice of the deficiency
- You will have 48-72 hours to provide updated documentation
- Platform access may be restricted until compliance is verified
- Access is restored upon receipt of valid documentation
The following are zero-tolerance violations and result in immediate termination of platform access, which is intended to be permanent (User Agreement & Code of Conduct, Section 10.3):
- Service of alcohol to any person under 21 years of age
- Service to visibly intoxicated persons in violation of California law
- Falsification of RBS certification, insurance, or identity documents
- Criminal conduct related to alcohol service
- Any conduct endangering guest safety
bartendersNow™ will:
- Report violations to California ABC when required by law
- Cooperate with law enforcement investigations
- Notify insurance carriers of incidents as required by policy terms
IMPORTANT: As an online marketplace, bartendersNow™ does not:
- Impose fines or financial penalties
- Require mandatory training as a corrective measure
- Place users under supervision or monitoring periods
- Implement progressive discipline systems
The platform's sole enforcement mechanism is restriction or termination of access.
